By commissioning Mochiflxwer, you agree to the following terms:

General Policies

You must be of legal age (18+)

You must credit Mochiflxwer for work when sharing/posting to social media

You will not use any of my art (commissioned or otherwise) for AI purposes, including but not limited to using AI for touchups, animating, or recreating my style with AI tools/programs.

You will only use the art for personal use and are not authorized to use the art for commercial use/purposes, unless we agreed to a commercial commission

I retain all copyright over my work, including the right to redistribute, reproduce, and use your commission as a sample for sales and/or self-promotion (unless you have bought full commercial rights)

You are not allowed to trace or heavily edit the work in any way, unless given explicit permission beforehand (i.e. for studying/practice without posting).

You may always use your commission as icon and/or banner for no extra fees (with credit)

I reserve the right to refuse any project for any reason

Unless commissioning a custom character sheet, pleaes provide a reference for your character[s] that I am going to draw. This can be a visual reference (previous character sheet or full images of character), or a written description (the more detail, the better!). Do not provide me with AI generated images as reference.

If commissioning a custom character sheet, please provide me with a mood board/inspiration board (does not have to be particularly extensive/detailed) . Ideally but optionally, a color palette would be extremely appreciated.

Payment Policy

Commissions are only officially accepted after payment is received

I will only accept $USD. You are responsible for currency conversions (Paypal does these automatically)

Payment is up front. I take full price upfront, unless you are getting a commission from the “Vtuber Model” section

If commissioning a vtuber model, I accept 50% payment up front, then 50% before sending final files

All payments must be paid within 10 days of receiving invoice from me. You will be reminded if you fail to deliver payment. If you fail to deliver payment after reminder, your invoice will be terminated and your commission will be cancelled. I will not work with you again in the future

I will always initiate our transactions through a Paypal invoice. Do not send me any kind of payment unless through this invoice. I will cover invoicing fees as per Paypal’s ToS

Full refunds are only available if I have not started your commission yet

Project Policy

Expect projects to take about 1 week to 1 month to complete, depending on project. This excludes vtuber related projects/character sheets, which can take up to a few months to complete.

You will always receive a sketch to ensure your approval before cleaning up the final piece. Once in the cleanup phase changes are not available except for a discussable fee

For vtuber model art, you will receive a ready-to-rig PSD with a .cmo3 file prepped for your rigger

For vtuber rigs, you will not receive the original .cmo3 file, you will receive a ready to use model with VTS settings (if assistance is needed with tracking adjustments, I will be available to assist you)

If you wish for your work to be kept private until completion (or specified date), this must be discussed upfront. It will also add a +50% fee of your total quote

Commercial Use Policy

If you wish to order your commission for commercial use, we will need to discuss and agree upon royalties, final commission price, and copyrights upfront

The minimum price of a commercial use commission will be x2 the non-commercial price. However, I reserve the right to charge more if deemed fitting

The following cases are considered commercial use: Reproducing and selling the artwork (including but not limited to: selling prints of said artwork, and/or selling merchandise with said artwork used as design for products). Publicly or privately, cases where you receive profit from a medium/platform where you have posted my artwork, (eg. Patreon, Fansly etc).
